Terms of Service

1. Acceptance of these Terms

These Terms of Service (“Terms”) are an agreement between you and POMEs (“POMEs”, “we”, “us”), the building-based community app operated by Soonk Paik. By creating an account, signing in, or using the POMEs mobile application or any related services (together, the “Service”), you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

2. Eligibility

You may use POMEs only if all of the following are true:

• You are at least 13 years of age. POMEs is not intended for children under 13.
• You are a resident of a building that is supported by POMEs. Buildings are admin-curated; if your building is not yet listed, you can submit a request from inside the app, but you cannot use the social features of the Service until your building is approved.
• The information you provide during onboarding (name, email, phone, building, unit number) is accurate and refers to you.
• You have the legal capacity to enter into a binding contract in your jurisdiction.

3. Your account

You are responsible for the activity that happens under your account. That means:

• You are responsible for keeping your sign-in credentials (or your Apple/Google identity provider) secure.
• You are responsible for the accuracy of the building and unit number you select. Misrepresenting where you live is a violation of these Terms.
• If you suspect unauthorized access to your account, notify us promptly at spaik@pomes.app so we can help.
• You may have only one active account per person, unless we expressly authorize otherwise.

POMEs relies on what you tell us. Apart from phone-number verification, we do not independently verify your name, photo, building, unit, or any other identifying information. By using POMEs, you represent that everything you submit is true and accurate. If you provide false, misleading, or impersonating information, you alone bear full responsibility for any resulting harm — whether to other users, to a building community, or to yourself — including any disputes, injuries, financial loss, or legal liability that follow. POMEs is not liable for harms caused by users who misrepresent themselves to other users or to the Service.

If you move, you must update or remove your building and unit from your profile. POMEs does not monitor or track your living situation, and we have no obligation to detect address changes on your behalf. Continuing to access building-specific content (building chats, neighbor requests, building events) for a building you no longer live in is a violation of these Terms and grounds for immediate suspension or termination of your account.

4. Acceptable use

POMEs is a small, building-scoped community. Please don’t do anything that would make it less safe or less pleasant for your neighbors. Specifically, you agree not to:

• Harass, bully, threaten, or stalk other users.
• Post or share content that is hateful, sexually explicit, violent, defamatory, or otherwise inappropriate for a residential community.
• List items in Borrow that are illegal, dangerous, regulated (e.g., firearms, controlled substances, prescription drugs), or that you do not own or have the right to lend.
• Request favors that are illegal, unsafe, or that solicit anything you wouldn’t feel comfortable asking a stranger.
• Impersonate another person, claim a building or unit you do not live in, or use a fake identity.
• Spam, phish, or send commercial solicitations to neighbors through chat, comments, posts, or notes.
• Scrape, crawl, reverse-engineer, or systematically collect data from the Service.
• Interfere with the Service, attempt to access accounts that aren’t yours, or probe for security vulnerabilities outside of any responsible-disclosure invitation we publish.

We may remove content or suspend or terminate accounts that violate these rules.

5. User content and license

You keep ownership of the content you create on POMEs — your profile, posts, borrow listings, favor requests, comments, notes, RSVPs, chat messages, and any photos you upload (“User Content”).

To run the Service, you grant POMEs a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your User Content within the app to other verified residents of your building (and, where it makes sense, to you across your own devices). This license lasts only as long as your User Content is on the Service. When you delete your User Content or your account, the license ends, except for backup copies that may persist for a short period in the ordinary course of running our infrastructure, and except as needed for the safety/legal retention described in our Privacy Policy.

We may remove User Content that we reasonably believe violates these Terms or applicable law, with or without notice.

6. Borrow and Favor — important disclaimers

POMEs is a directory and a connector. POMEs is not a party to anything that happens between you and your neighbor. Please read this section carefully.

• If you list an item to Borrow, the arrangement is between you and the neighbor who borrows it. POMEs does not insure, guarantee, or replace lent items. We do not handle deposits, payments, or escrow.
• If you post or accept a Favor (for example, walking a dog or signing for a package), the favor is between you and the neighbor. POMEs does not employ, supervise, vet, or insure either side. Favors are neighborly help, not paid services.
• We do not verify your identity beyond what Firebase Authentication, Sign in with Apple, or Sign in with Google provide. We verify the email or identity-provider account — not that you are the person you say you are in real life.
• We do not mediate disputes between neighbors. If something goes wrong, the parties are expected to resolve it themselves, and to involve building management or local authorities where appropriate.
• Use common sense. Meet in common areas of your building. Don’t share more contact information than you’re comfortable with. Don’t lend items you can’t afford to lose.

POMEs does not process payments. No money flows through the Service. If you and a neighbor agree to compensate each other for something, that arrangement is entirely between the two of you and outside the scope of this Service.

7. Events

If you host an event through POMEs, you are the host — not POMEs. You are responsible for the safety of the event, for managing attendance, for following any rules your building (or its landlord, co-op, or HOA) has about gatherings, and for complying with applicable law. POMEs is not a co-host, sponsor, organizer, or insurer of any event.

Attendees: please RSVP honestly and respect the host’s rules.

8. Chat and notes

POMEs offers two kinds of chat:

• One-on-one direct messages between you and another verified neighbor, intended for neighborly coordination (“hey, I’m heading down with the drill in 10 minutes”).
• Group chats with multiple participants — for example, building members, event attendees, or interest groups. Anything you post in a group chat is visible to every participant in that chat, so treat group chats as semi-public conversations among the participants.

You are solely responsible for the content you share in either format. We do not actively monitor chat content, but we may review messages that are reported to us for safety or Terms-violation reasons.

“Notes” (thank-you notes tied to a specific neighbor) follow the same acceptable-use rules as the rest of the app.

9. Termination

You can stop using POMEs at any time and delete your account from inside the app via the “Delete Account” control. When you do, we run the cascade delete described in our Privacy Policy.

We may suspend or terminate your account if we reasonably believe you have violated these Terms, if your continued use creates a safety or legal risk to other users or to us, or if we are required to do so by law. Where it’s practical and appropriate, we’ll let you know why.

10. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, secure, or error-free.

POMEs makes no warranty about other users — their identity, their behavior, the items they offer to lend, the favors they offer or request, or the events they host. You interact with neighbors at your own risk.

11. Limitation of liability

To the fullest extent permitted by law, POMEs and Soonk Paik will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses arising out of or related to your use of the Service.

POMEs does not charge users any fees, and no money flows through the Service. Accordingly, our total cumulative liability to you for any claim related to the Service is limited to US $0, which represents the amount you have paid us. Some jurisdictions do not allow limitations of liability for certain damages; in those jurisdictions our liability is limited to the smallest amount permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless POMEs and Soonk Paik from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with (a) your access to or use of the Service, (b) your User Content, (c) your interactions with other users (including any borrow arrangement, favor, event, or chat), or (d) your violation of these Terms or any applicable law.

13. Governing law and disputes

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-law rules. Any dispute arising out of or related to these Terms or the Service that the parties cannot resolve informally will be brought exclusively in the state or federal courts located in New York County, New York, and you and POMEs each consent to the personal jurisdiction of those courts.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date, post an in-app banner the next time you open the app, and (where we have your email) send you an email summarizing what changed. Continued use of the Service after the changes take effect means you accept the updated Terms.
